     Prohibits expenditure of State funds for certain cosmetic services in criminal trials.

An Act prohibiting expenditure of State funds on certain cosmetic services in criminal trials and amending P.L.1967, c.43.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 13 of P.L.1967, c.43 (C.2A:158A-13) is amended to read as follows:

     13.  In providing legal services to defendants pursuant to this act, the Office of the Public Defender and every attorney actually engaged in the performance of the same, whether as a member of the staff or engaged on a case basis or otherwise[, ]:

     a.     shall adhere at all times to the standards and level of performance established from time to time by the Supreme Court of New Jersey in the execution of its duty to supervise the practice of law; and the office shall furnish to such court materials and data as may be requisite to the measurement of the adequacy of the performance hereunder; and

     b.    shall not expend any State funds or charge the State or other governmental entity for costs of any cosmetics or cosmetic services performed to alter the appearance of a defendant in a criminal trial.  "Cosmetic services" in this paragraph means applying cosmetic preparations, antiseptics, tonics, lotions, creams or makeup to the hair, scalp, face, neck or upper part of the body especially to cover tattoos.

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill prohibits the expenditure of State funds by the Office of the Public Defender or other attorney providing the same services, on cosmetic services for defendants in a criminal trial.

     The bill defines “cosmetic services” as applying cosmetic preparations, antiseptics, tonics, lotions, creams or makeup to the hair, scalp, face, neck or upper part of the body especially to cover tattoos.
