SYNOPSIS

     Requires construction of new buildings, facilities, and structures using State, EDA, or NJ Schools Development Authority funds to include green or blue roofs.

An Act concerning the construction of certain buildings, facilities, and structures and supplementing Titles 34 and 52 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Any new building, facility, or structure, the construction of which is funded in whole or in part by the New Jersey Economic Development Authority, that is to be constructed after the effective date of this act shall be designed, constructed, and managed to include a functioning green roof or blue roof.

     All plans, specifications and bid proposal documents for any building, facility, or structure to which the provisions of this section apply shall identify the design standards to be used for the green roof or blue roof and the requirements for its maintenance.

     The Chief Executive Officer of the New Jersey Economic Development Authority shall enforce the provisions of this section.

     b.    The requirements of this section shall not apply to any building, facility, or structure for which a request for proposal for entering into a contract to design the building, facility, or structure has been issued prior to the effective date of this act.

     c.     As used in this section:

     “Blue roof” means a roof constructed with mechanical controls that drain stormwater, including but not limited to gravel beds, perforated pipes, rooftop detention systems, or weirs, designed to improve stormwater management.

     “Green roof” means a roof that includes, among other things, a growth medium and a vegetation layer of drought resistant and hardy plant species, designed to improve stormwater management.

 

     2.    a.  Any new building, facility, or structure, the construction of which is funded in whole or in part by the State, that is to be constructed after the effective date of this act shall be designed, constructed, and managed to include a functioning green roof or blue roof.

     The State Treasurer shall enforce the provisions of this section.

     b.    The requirements of this section shall not apply to any building, facility, or structure for which a request for proposal for entering into a contract to design the building, facility, or structure has been issued prior to the effective date of this act.

     c.     As used in this section:

     All plans, specifications and bid proposal documents for any school building, facility, or structure to which the provisions of this section apply shall identify the design standards to be used for the green roof or blue roof and the requirements for its maintenance.

     The Chief Executive Officer of the New Jersey Schools Development Authority shall enforce the provisions of this section.

     b.    The requirements of this section shall not apply to any school building, facility, or structure for which a request for proposal for entering into a contract to design the building, facility, or structure has been issued prior to the effective date of this act.

     c.     As used in this section:

     4.    This act shall take effect on the first day of the 13th month following the date of enactment.

 

 

STATEMENT

 

     This bill would require any new building, facility, or structure, the construction of which is funded in whole or in part by the State, the New Jersey Economic Development Authority, or the New Jersey Schools Development Authority, to be designed, constructed, and managed to include a functioning green roof or blue roof.  All plans, specifications and bid proposal documents for any building, facility, or structure to which the bill applies would be required to identify the design standards to be used for the green roof or blue roof and the requirements for its maintenance.

     The State Treasurer, the Chief Executive Officer of the New Jersey Economic Development Authority, or the Chief Executive Officer of the New Jersey Schools Development Authority, as appropriate, would enforce the provisions of the bill.

     The requirements of the bill do not to apply to any building, facility, or structure for which a request for proposal for entering into a contract to design the building, facility, or structure has been issued prior to the effective date of the bill.

     The bill would take effect on the first day of the 13th month following the date of enactment of the bill into law.
