SYNOPSIS

     “Mainland Memoriam Act”; directs MVC to create graduated driver’s license informational material to be distributed by motor vehicle dealers.

An Act concerning distribution of information on graduated driver’s license laws, and supplementing P.L.2003, c.13 (C.39:2A-1 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

1.    a.  This act shall be known and may be cited as the “Mainland Memoriam Act.”

     b.    As used in this act:

     “Dealer” means any person engaged in the business of selling or leasing motor vehicles to consumers or other end users and licensed pursuant to R.S.39:10-19.

     “Motor Vehicle” means a passenger automobile or motorcycle as defined in R.S.39:1-1.

     c.    (1) The Chief Administrator of the New Jersey Motor Vehicle Commission shall create written informational material detailing the laws and conditions applicable to holders of special learner’s permits, examination permits, and probationary driver’s licenses and provide the informational material to dealers.

     (2)   At the time of purchase or lease of a motor vehicle, a dealer shall distribute the written informational material created by the New Jersey Motor Vehicle Commission pursuant to paragraph (1) of subsection c. of this section, to a person purchasing or leasing a motor vehicle from the dealer.

 

     2.    This act shall take effect on the first day of the seventh month after enactment but the Chief Administrator may take any anticipatory action in advance as shall be necessary for the implementation of this act.

 

 

STATEMENT

 

     This bill enacts the “Mainland Memoriam Act” and requires motor vehicle dealers to provide written informational material on the State’s graduated driver’s license laws to a person buying or leasing a motor vehicle in order to increase awareness of these laws and their respective restrictions.

     This bill directs the Chief Administrator of the Motor Vehicle Commission to create and distribute to motor vehicle dealers written informational material detailing graduated driver’s license laws. The dealer is required to distribute the informational material to the buyer or leasee of a motor vehicle.

     This bill is named the “Mainland Memoriam Act” in honor of four Mainland Regional High School football players who were tragically killed in a motor vehicle accident. In August 2011, eight Mainland Regional High School football players traveled to meet their coaches and fellow teammates for a traditional end of summer breakfast to celebrate the last practice of summer. On their way, these eight football players were involved in a fatal motor vehicle accident on the Garden State Parkway, resulting in the death of four players. In light of this tragedy, the bill endeavors to prevent tragic motor vehicle accidents by expanding knowledge of the State’s graduated driver’s license laws.
