     Establishes sheriff’s officers reemployment lists.

An Act concerning civil service reemployment lists and amending N.J.S.11A:4-9.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    N.J.S.11A:4-9 is amended to read as follows: 

     11A:4-9  The commission may establish the following types of eligible lists:

     a.    Open competitive, which shall include all qualified eligibles without regard to whether they are currently employed by the State or a political subdivision;

     b.    Promotional, which shall include qualified permanent eligibles;

     c.    Regular reemployment, which shall include former permanent employees who resigned in good standing and whose reemployment is certified by the appointing authority as in the best interest of the service.  The name of any such employee shall not remain on a reemployment list for more than three years from the date of resignation, unless otherwise extended pursuant to N.J.S.11A:4-6;

     d.    Police, sheriff’s officer, or fire reemployment, which shall include former permanent uniformed members of a police, sheriff’s office, or fire department who have resigned in good standing and whose reemployment is certified by the appointing authority as in the best interest of the service; and

     e.    Special reemployment, which shall include permanent employees laid off or demoted in lieu of layoff from permanent titles.

     2.    This act shall take effect immediately and shall be retroactive to January 1, 2002. 

 

 

STATEMENT

 

     This bill establishes civil service sheriff’s officer reemployment lists. 

     Civil service regular reemployment lists are comprised of former permanent civil service employees who resigned in good standing, received a general resignation, retired, or were voluntarily demoted, who timely requested reemployment and whose reemployment was certified by the appointing authority as being in the best interests of the service.  Regular reemployment lists are valid for three years,
unless extended by the commission to a maximum of four years. 

     Civil service police and fire reemployment lists include former police officers and firefighters who have resigned in good standing and whose reemployment is certified by the appointing authority as in the best interest of the service.  Police and fire reemployment lists have unlimited duration. 

     Since current law does not specifically establish a sheriff’s officer reemployment list, the Civil Service Commission places former sheriff’s officers on regular reemployment lists which expire after three years.  This bill establishes special sheriff’s officers reemployment lists similar to police and fire reemployment lists.  It is the sponsor’s intent that sheriff’s officer reemployment lists also be of unlimited duration. 

     The bill is retroactive to January 1, 2002.
