SYNOPSIS

     Extends center and growth center designations pursuant to “State Planning Act” for three years.

An Act extending the validity of certain center and growth center designations, and supplementing P.L.1985, c.398 (C.52:18A-196 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  Notwithstanding any provision of the “State Planning Act,” P.L.1985, c.398 (C.52:18A-196 et seq.), the “Permit Extension Act of 2008,” P.L.2008, c.78 (C.40:55D-136.1 et seq.), or any rule or regulation adopted pursuant thereto, to the contrary, the expiration date of an area designated pursuant to P.L.1985, c.398 (C.52:18A-196 et seq.) as a designated center or designated growth center in an endorsed plan shall be extended for three years from the date of enactment of this act.

 

     2.  This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would extend the expiration date of any area designated pursuant to the State Development and Redevelopment Plan adopted pursuant to the “State Planning Act,” P.L.1985, c.398 (C.52:18A-196 et seq.), as a designated center or a designated growth center in an endorsed plan for three years from the date this bill is enacted into law.  Numerous designated centers and designated growth centers expire on December 31, 2014.  These designations are based on the area, population, density, and employment of the center being considered and features of the surrounding areas, and range in scale in the following order:  urban, regional, town, village, and hamlet.  Centers represent an efficient and compact form of development having one or more mixed-use cores, residential neighborhoods and green spaces.  This bill would extend the validity of the current designations, thus ensuring that these areas remain eligible for various State incentives currently made available to them due to their designation as a designated center or designated growth center.
