SYNOPSIS

     Clarifies police powers of sheriff's officers in certain counties to enforce motor vehicle and traffic laws.

An Act concerning the enforcement of motor vehicle laws by sheriff’s officers and supplementing Title 2A of the New Jersey Statutes

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    A sheriff’s officer of a county of the first class with a population of over 900,000 and a population density of less than 4,000 persons per square mile according to the 2010 federal decennial census, wherein the sheriff conducts road patrols, shall have the powers to enforce all the provisions of Title 39 of the Revised Statutes including the provisions of section 5 of P.L.1950, c.142 (C.39:3-84.3) provided the sheriff’s officer is fully trained and certified and the county provides all the equipment appropriate and necessary for such enforcement.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides that sheriff’s officers in counties of the first class with a population of over 900,000 and a population density of less than 4,000 persons per square mile according to the 2010 census, where the sheriff conducts road patrols, have the power to enforce all the provisions of Title 39 of the Revised Statutes (the State Motor Vehicle Code.)

     This includes the authority to measure and weigh vehicles pursuant to section 5 of P.L.1950, c.142 (C.39:3-84.3) if the officers are properly trained and certified and the county provides all the necessary and appropriate equipment.
