SYNOPSIS

     Concerns emergency assistance which is repaid by the recipient.

An Act concerning emergency assistance payments and supplementing P.L.1997, c.14.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    The Commissioner of Human Services shall not count months of emergency assistance, which were repaid to a county or municipal agency, in accordance with the agreement to repay, toward a recipient’s time limit, as established by section 8 of P.L.1997, c.14 (C.44:10-51), for the receipt of emergency assistance.

 

     2.    The Commissioner of Human Services shall adopt rules and regulations pursuant to the “Administrative Procedure Act,” P.L.1968, c.410 (C.52:14B-1 et seq.), to effectuate the purposes of this act.

 

     3.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would clarify how the Department of Human Services imposes time limits on the receipt of emergency assistance. 

     The bill would require the department to disregard any months of emergency assistance for which payments issued by the State to the recipient were repaid by the recipient from a recipient’s 12 month lifetime limit of emergency assistance.
