SYNOPSIS

     Increases penalty for speeding in school zone.

An Act concerning certain motor vehicle violations and amending P.L.1997, c.415.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 6 of P.L.1997, c.415 (C.39:4-98.7) is amended to read as follows:

     6.    a.  The fine for a motor vehicle offense shall be double the amount specified by law when traveling 20 miles per hour or more over the designated speed limit [as set forth in] established pursuant to subsections b. and c. of R.S.39:4-98, except as provided in subsection b. of section 1 of P.L.1993, c.332 (C.39:4-203.5) and subsection a. of section 5 of P.L.1997, c.415 (C.39:4-98.6).

     b.    The fine for a motor vehicle offense shall be triple the amount specified by law when traveling through a school zone in violation of subsection a. of R.S.39:4-98.

     2.    This act shall take effect immediately. 

 

 

STATEMENT

 

     This bill increases the penalty for exceeding the 25 mile per hour speed limit while driving through a school zone when children are present. 

     The current fine for a motor vehicle offense is double the amount imposed by law when a person is driving 20 miles per hour or more over the posted speed limit while traveling through a school zone at certain times when children are present.  This bill triples the fine imposed by current law when a person exceeds the 25 mile per hour speed limit while traveling through a school zone.
