     Requires filing of initial and amendatory alcoholic beverage price list.

An Act concerning alcoholic beverages and supplementing Title 33 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

      1.   a. A licensee or registrant intending to sell an alcoholic beverage to retailers in this State shall file a price list with the Division of Alcoholic Beverage Control no later than the 15th day of the month preceding the month in which the alcoholic beverage will initially be sold in this State.  The price list shall become effective the first day of the following month and remain in effect until an amended price list becomes effective as provided in subsection c. of this section.

      b.   The price list shall include:

     (1)   the price of the product, including per unit costs, discounts, allowances and differentials, and other terms of sale;

     (2)   the brand or trade name of the product; its nature or type; the brand registration number; the size, age, and proof of alcoholic content; the standard number of unit containers per standard case; and the capacity of each unit container; and

     (3)   any additional information required by the director.

      c.    A licensee or registrant selling an alcoholic beverage to retailers in this State shall file an amendatory price list with the division no later than the 15th day of the month preceding the month in which the price of the alcoholic beverage will change.  The amendatory price list shall become effective on the first day of the following month and shall include all information established pursuant to subsection b. of this section.

      d.   As used in this section, “unit” means a can, bottle, or individualized container.

 

      2.   The director shall permit a licensee or registrant required to file an initial or amendatory price list pursuant to section 1 of P.L.    , c.    (C.        ) (pending before the Legislature as this bill) to electronically file the initial or amendatory price list.

 

      3.   Section 1 of this act shall take effect immediately.  Section 2 of this act shall take effect immediately, but shall be inoperative until the first day of the 37th month following enactment.

 

 

STATEMENT

 

     This bill requires a licensee or registrant intending to sell an alcoholic beverage in New Jersey to file a price list with the Division of Alcoholic Beverage Control (ABC). 

     The price list is to be filed by the 15th day of the month preceding the month in which the alcoholic beverage will be initially sold in New Jersey and is to include: (1) certain information concerning the price of the product, (2) certain information concerning the product, including but not limited to the product’s brand or trade name and brand registration number, and (3) any additional information required by the Director of ABC.   Under the provisions of the bill, an amended price list is required to be filed on the 15th day of the month prior to the month in which the price of the alcoholic beverage will change.  The amendatory price list will become effective the following month.  Within three years, the director is required to permit electronic filing of an initial or amendatory price list. 

     Currently, ABC requires a current price list to be filed monthly regardless of whether there is a change in the price of the alcoholic beverage.  This bill will require a price list to be filed prior to the initial sale of an alcoholic beverage in this State and when the price of the alcoholic beverage changes.
