SYNOPSIS

     Requires retailers to post warnings of lead poisoning from improper paint removal.

An Act requiring certain retailers to post warnings of lead poisoning and supplementing P.L.1985, c.84 (C.26:2-130 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Any retailer that offers paint or other supplies intended for the removal of paint shall display, in a prominent and easily visible location, a poster as provided in subsection b. of this section, which contains, at a minimum, the following:

     (1)   a statement that dry sanding and dry scraping of paint in dwellings built before 1978 is dangerous;

     (2)   a statement that the improper removal of old paint is a significant source of lead dust and the primary cause of lead poisoning; and

     (3)   contact information where consumers can obtain more information.

     b.    The Department of Health shall provide sample poster forms for use by retailers.  The department shall make these posters available via download from the department's Internet website.

 

     2.    This act shall take effect on the first day of the fourth month following enactment.

 

 

STATEMENT

 

     This bill requires retailers who sell paint or supplies intended for the removal of paint to display posters warning that lead poisoning could result from the improper removal of paint.  At a minimum, the signs must:

·       warn that dry sanding or scraping of paint from dwellings built before 1978 is dangerous;

·        warn that improper removal of old paint is a significant source of lead dust and the primary cause of lead poisoning; and

·       provide contact information where consumers can obtain more information.

     Under the bill, the Department of Health is required to make sample poster forms available for download through its website.
