SYNOPSIS

     Requires MVC to enter into agreement with car dealers to have car dealers notify certain motorists of availability of specialty license plates.

An Act concerning specialty license plates and supplementing Title 39 of the Revised Statutes and P.L.1994, c.190 (C.56:12-60 et al.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Notwithstanding the provisions of any law, rule, regulation, or order to the contrary, the Chief Administrator of the New Jersey Motor Vehicle Commission shall enter into an agreement with every motor vehicle dealer, licensed pursuant to R.S.39:10-19, concerning specialty license plates available to the public pursuant to Title 39 of the Revised Statutes.  The agreement shall include a provision that, at the time a person agrees, in writing, to purchase a motor vehicle; the motor vehicle dealer shall notify the prospective motor vehicle purchaser of the opportunity to obtain a specialty license plate for that motor vehicle.  The notification provision shall be a condition of a motor vehicle dealer receiving and maintaining a license pursuant to R.S.39:10-19.

 

     2.    Notwithstanding the provisions of any law, rule, regulation, or order to the contrary, the Chief Administrator of the New Jersey Motor Vehicle Commission shall enter into an agreement with every leasing dealer, as defined pursuant to section 2 of P.L.1994, c.190 (C.56:12-61), concerning specialty license plates available to the public pursuant to Title 39 of the Revised Statutes.  The agreement shall include a provision that, at the time a person agrees, in writing, to lease a motor vehicle; the leasing dealer shall notify the prospective motor vehicle lessee of the opportunity to obtain a specialty license plate for that motor vehicle.  The notification provision shall be included as a provision within a lease agreement required pursuant to section 3 of P.L.1994, c.190 (C.56:12-62).

 

     3.    This act shall take effect immediately, but shall remain inoperative for 90 days following the date of enactment.

 

STATEMENT

 

     This bill requires the New Jersey Motor Vehicle Commission to enter into an agreement with motor vehicle dealers concerning the notice to purchasers and lessees of new and used motor vehicles.  The agreement is to provide that, at the time a person purchases or leases a motor vehicle, the motor vehicle dealer is required to notify the prospective purchaser or lessee of the opportunity to obtain a specialty license plate for that motor vehicle.  The notification provision is to be a condition of a motor vehicle dealer receiving and maintaining a motor vehicle dealer license and included as a provision within a lease agreement.
