     Requires notaries public to be U.S. citizens.

An Act requiring notaries public to be United States citizens and amending P.L.1979, c.460.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 3 of P.L.1979, c.460 (C.52:7-12) is amended to read as follows:

     3.    No person shall be appointed a notary public unless he is 18 years of age or older and a citizen of the United States.

     2.    This act shall take effect on the 30th day after enactment and shall apply to any person seeking appointment to or renewal of a term as a commissioned notary public on or after that date.

 

 

STATEMENT

 

     This bill amends the "Notaries Public Act of 1979" to require that persons appointed as notaries public be citizens of the United States.  This provision applies to persons seeking new appointments and to persons seeking renewal of their terms on or after the 30th day after enactment of this bill.

     There is no citizenship requirement under current law in New Jersey; however, several states, including New York and Virginia, require that notaries public be United States citizens.
