     Permits transfer of certain special license plates to immediate family member.

An Act concerning the transfer of certain license plates and amending P.L.1999, c.192.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  Section 1 of P.L.1999, c.192 (C.39:3-33a) is amended to read as follows:

     1.    Whenever the [Division of Motor Vehicles] New Jersey Motor Vehicle Commission is authorized to charge an additional application fee for the issuance of a personalized, courtesy, or special license plate, the [division] commission shall charge that additional application fee only upon the initial issuance of the plate.  If a personalized, courtesy, or special plate is issued to a lessee in a motor vehicle leasing agreement, upon termination of the lease the lessee may apply to the [director] chief administrator to have the plate reissued to another motor vehicle leased or owned by the lessee or to a motor vehicle leased or owned by an immediate family member of the lessee, upon payment of a fee of $4.50.  If a personalized, courtesy, or special license plate is issued to an owner of a motor vehicle, the owner may apply to the [director] chief administrator to have the plate reissued to another motor vehicle leased or owned by the owner or to a motor vehicle leased or owned by an immediate family member of the owner, upon payment of a fee of $4.50.  Nothing in this section shall be construed as prohibiting the [division] chief administrator from charging, at the time of annual registration renewal, the payment of the additional fee which has been required under any other section of law for a special license plate.

     For the purposes of this section, “immediate family member” means a person’s spouse, child, parent, or sibling.

     2.  This act shall take effect on the first day of the six month following enactment, but the Chief Administrator may take such anticipatory actions as may be necessary for the timely implementation of this act.

 

 

STATEMENT

 

     This bill permits the owner or lessee of motor vehicle to transfer personalized, courtesy, or special license plates to a motor vehicle owned or leased by an immediate family member, upon the payment of a fee of $4.50.  The bill defines “immediate family member” as a person’s spouse, child, parent, or sibling.

     Current law only provides for the transfer of personalized, courtesy, or special license plates to another motor vehicle owned or leased by the owner or lessee, and not to a motor vehicle owned or leased by an immediate family member of the owner or leesee.  To transfer such plates to an immediate family member, the New Jersey Motor Vehicle Commission (MVC) requires the owner or lessee to surrender the license plates to MVC, then MVC may issue the license plates to the immediate family member as an initial issuance, upon the payment of the fee for initial issuance of $50 plus any other fees for the license plates required under law.
