SYNOPSIS

     Prohibits student who commits certain sexual offenses from attending same school building or using same school bus as victim of offense.

An Act concerning students who commit certain sexual offenses and supplementing chapter 43 of Title 2C of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  A student who is enrolled in a public school that includes any of the grades kindergarten through 12 and who is convicted of, or adjudicated delinquent for an act which if committed by an adult would constitute, a violation of N.J.S.2C:14-2 or N.J.S.2C:14-3, or an attempt to commit any of these offenses, shall be prohibited from the following:

     (1) attending the same school building that is attended by the victim of the violation; and

     (2) utilizing the same school bus that is used by the victim of the violation for transportation to and from school.

     b.    A court shall order the prohibitions required by subsection a. of this section as part of the court’s imposition of sentence, disposition of delinquency, probation order, or other  disposition made pursuant to law.

 

     2.    This act shall take effect on the first day of the third month next following the date of enactment.

 

 

STATEMENT

 

     This bill prohibits a student enrolled in a public school who is convicted of, or adjudicated delinquent for, committing aggravated sexual assault or sexual assault under N.J.S.2C:14-2 or aggravated criminal sexual contact or criminal sexual contact under N.J.S.2C:14-3, or an attempt to commit any of these offenses, from: (1) attending the same school building that is attended by the victim of the violation, and (2) utilizing the same school bus that is used by the victim for transportation to and from school.  The court will order these prohibitions as part of the sentence, disposition of delinquency, probation order, or other disposition for the offense.

     This bill is similar to a bill recently introduced in the state of Michigan in order to ensure that a juvenile who sexually assaulted several students could be prohibited from returning to the same school building and same bus route as his victims.
