An Act concerning hunting and fishing on State lands and supplementing Title 23 of the Revised Statutes.

Be It Enacted by the Senate and General Assembly of the State of New Jersey:

     1.    a.  A person who possesses all the necessary licenses, permits, and stamps to hunt or fish, and is denied access to hunt or fish on State lands due to an executive order issued by the Governor at a date and time during which it would otherwise be permissible to hunt or fish under the State Fish and Game Code, shall be entitled to a full refund of all fees paid by the person for each license, permit, or stamp issued pursuant to chapter 3 of Title 23 of the Revised Statutes.

     b.    The Division of Fish and Wildlife shall provide a refund upon application on a form and in a manner prescribed by the division.  The application shall include:

     (1)   a demonstration by the applicant that they were denied the ability to hunt and fish due to an executive order; and

     (2)   a receipt or proof of purchase for each hunting or fishing license, permit, or stamp paid for by the applicant.

     2.    This act shall take effect immediately.

STATEMENT

This bill would require the Division of Fish and Wildlife to provide a refund of all hunting or fishing fees to a person who is denied access to State lands to hunt or fish, because of an executive order issued by the Governor, at a date and time at which hunting and fishing would otherwise be permissible.
