SYNOPSIS

     Provides that biennial renewal of license or certificate issued by New Jersey Board of Nursing is due on professional’s birthday.

An Act concerning the New Jersey Board of Nursing and amending P.L.1972, c.108.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 1 of P.L.1972, c.108 (C.45:1-7) is amended to read as follows:

     1.    Notwithstanding any of the provisions of Title 45 of the Revised Statutes or of any other law to the contrary, all professional or occupational licenses or certificates of registration, except such licenses or certificates issued to real estate brokers or salesmen pursuant to chapter 15 of Title 45, which prior to the effective date of [this act] P.L.1972, c.108 were issued for periods not exceeding one year and were annually renewable, shall, on and after the effective date of [this act] P.L.1972, c.108, be issued for periods of two years and be biennially renewable, except that licenses and business permits issued to electrical contractors and certificates of registration issued to qualified journeymen electricians pursuant to chapter 5A of Title 45 shall be issued for periods of three years and be triennially renewable; provided, however, the boards or commissions in charge of the issuance or renewal of such licenses or certificates, other than the New Jersey Board of Nursing, may, in order to stagger the expiration dates thereof, provide that those first issued or renewed after the effective date of [this act] P.L.1972, c.108, shall expire and become void on a date fixed by the respective boards or commissions, not sooner than six months nor later than 29 months, after the date of issue. 

     In the case of licenses and certificates issued by the New Jersey Board of Nursing, any such license or certificate issued or renewed after the effective date of P.L.    , c.    (pending before the Legislature as this bill) shall expire and become void on the same calendar day as the holder’s date of birth in the second calendar year following the date on which the license or certificate was issued.  If the holder’s date of birth does not correspond to a calendar day of the year in which the license or certificate expires, the license or certificate shall expire on the last day of the holder’s birth month in that year.

     The fees for the respective licenses and certificates of registration issued pursuant to [this act] P.L.1972, c.108 for periods of less or greater than one year shall be in amounts proportionately less or greater than the fees established by law.

     2.    This act shall take effect 30 days after the date of enactment and shall apply only to licenses and certificates issued by the New Jersey Board of Nursing on and after the effective date.

 

 

STATEMENT

 

     This bill provides that licenses and certificates issued by the New Jersey Board of Nursing are to expire on the professional’s birthday, rather than on one of two fixed dates, as is the practice under current law.  If the person’s birthday does not correspond with a calendar day in the renewal year, the license or certificate will expire on the last day of the person’s birth month in the renewal year.  Licenses and certificates issued by the New Jersey Board of Nursing will continue to be valid for two years.

     The list of professionals licensed or certified through the New Jersey Board of Nursing includes registered professional nurses, licensed practical nurses, homemaker-home health aides, advanced practice nurses, and forensic nurses-certified sexual assault.  The bill will take effect 30 days after the date of enactment and will apply to any license or certificate issued by the Board of Nursing on or after that effective date.
