     Prohibits municipalities from charging annual fee for storm water permits and inspections.

An Act concerning certain annual fees by municipalities for storm water permits and inspections and supplementing Title 40 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Notwithstanding any provision of the "Municipal Land Use Law," P.L.1975, c.291 (C.40:55D-1 et seq.), the "Water Pollution Control Act," P.L.1977, c.74 (C.58:10A-1 et seq.), or any other law, or rule or regulation adopted pursuant thereto, to the contrary, a municipality shall not impose an annual fee for a permit or inspection related to the implementation of a storm water ordinance adopted by the municipality in compliance with federal or State law, unless such an annual fee is specifically required by federal or State law; however, nothing in this section shall prevent a municipality from imposing a fee for a storm water permit or inspection due to a change in conditions or development at a site.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would prohibit a municipality from charging an annual fee for a permit or inspection related to implementation of a municipal storm water ordinance adopted in compliance with federal or State law, unless the annual fee is specifically required by federal or State law.  However, nothing in the bill would prevent a municipality from charging a fee for a storm water permit or inspection due to a change in conditions or development at a site.
