     Requires MVC to establish process to apply for non-driver photo identification cards through county clerks.

An Act concerning application procedures for certain non-driver photo identification cards and supplementing Title 39 of the Revised Statutes and Title 40A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  The Chief Administrator of the Motor Vehicle Commission shall establish a procedure by which an applicant for a non-driver photo identification card, issued pursuant to section 2 of P.L.1980, c.47 (C.39:3-29.3), or a renewal application thereof, may submit the application to a county clerk for the county clerk to submit to the commission on the applicant’s behalf.

 

     2.  A county clerk may establish a program to assist county residents to apply for a non-driver photo identification card issued pursuant to section 2 of P.L.1980, c.47 (C.39:3-29.3), or a renewal thereof, in accordance with the procedure established by the Chief Administrator of the Motor Vehicle Commission, pursuant to section 1 of P.L. , c.   (C.     ) (pending before the Legislature as this bill).

    

     3.  The Chief Administrator of the Motor Vehicle Commission shall adopt, pursuant to the “Administrative Procedure Act,” P.L.1968, c.410 (C.52:14B-1 et seq.), and within 90 days following the date of enactment, any rules and regulations necessary to carry out the provisions of this act.

 

     4.  This act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides county clerks with the authority to assist county residents in applying for and renewing a non-driver photo identification card issued by the Motor Vehicle Commission (MVC).

     County clerks currently process passport applications and passport renewal applications, which documents are transmitted from the county office to the United States Department of State for issuance to the applicant.

     This legislation would permit counties to establish a similar program to assist county residents in applying for MVC issued non-driver photo identification. Under the bill, the Chief Administrator of the MVC would be required to establish the procedure by which the application process would operate. Additionally, under the bill, counties are permitted, but not required to establish an application program.
