SYNOPSIS

     Requires board of education to implement program of annual random drug testing for school employees.

An Act concerning drug testing for school employees and supplementing chapter 16 of Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  A board of education shall develop and implement a drug testing program for school employees.  Under the program, all teachers and other current employees of the school district shall be tested once a year, at random, for usage of controlled dangerous substances as defined in N.J.S.2C:35-2. The testing shall be conducted by a school physician, school nurse, or a physician, laboratory, or health care facility designated by the board of education.

     b.    The Department of Education, in consultation with the Department of Health, shall develop guidelines for boards of education for the testing required under subsection a. of this section including, but not limited to, guidelines on the procedures for collecting and testing specimens and the manner in which employees shall be randomly selected for drug testing.

 

     2.    This act shall take effect in the first full school year following the date of enactment.

 

 

STATEMENT

 

     This bill requires all boards of education to implement a drug testing program in which all teachers and other current school district employees will be tested once a year, at random, for the use of controlled dangerous substances.  The testing will be conducted by a school physician, school nurse, or a physician, laboratory, or health care facility designated by the board of education.  The bill directs the Department of Education, in consultation with the Department of Health, to develop guidelines for the drug testing, including guidelines on the procedures for collecting and testing specimens and the manner in which school employees will be randomly selected for the testing.
