SYNOPSIS

     Requires owner or operator of residential rental property to notify tenants when licensed pesticide applicator applies pesticide on property.

An Act concerning the application of pesticides on residential rental properties and supplementing P.L.1971, c.176 (C.13:1F-1 et seq.)

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  The owner or operator of a residential rental property shall notify each tenant of the rental property whenever a pesticide is to be applied at the residential rental property by a licensed pesticide applicator, at least 24 hours before the pesticide application.  The owner or operator shall provide this notice by placing flags at appropriate intervals on the property where the pesticide is to be applied.  The flags shall be date and time stamped with the date and time when the pesticide shall be applied and the date and time by which it shall be considered safe for people and pets to access the property where the pesticide was applied.

     b.    The owner or operator of a residential rental property shall notify in writing each tenant of the residential rental property of the notification requirement and the method of notification established pursuant to subsection a. of this section at the time the tenant assumes occupancy of the rental property.

     c.     The department shall adopt, pursuant to the “Administrative Procedure Act,” P.L.1968, c.410 (C.52:14B-1 et seq.), rules and regulations necessary for the implementation of this act.

    

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires the owner or operator of a residential rental property to notify each tenant of the rental property whenever a pesticide is to be applied on the property by a licensed pesticide applicator, at least 24 hours before the pesticide application.  The bill requires the owner or operator to provide notice by placing flags at appropriate intervals on the property where the pesticide is to be applied.  The bill specifies that the flags be date and time stamped with the date and time when the pesticide is going to be applied and the date and time by which it would be considered safe for people and pets to access the property where the pesticide was applied.

     Furthermore, the bill also requires the owner or operator to notify the tenant of the notification requirements and methods of notification established by the bill at the time the tenant assumes occupancy of the rental property.

     The bill requires the Department of Environmental Protection to adopt rules and regulations necessary to implement the bill.
