SYNOPSIS

     Removes requirement that all boards of education be members of NJSBA.

An Act concerning the New Jersey School Boards Association and amending various sections of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1. N.J.S.18A:6-45 is amended to read as follows:

     18A:6-45.  There is established a body corporate and politic, with corporate succession, to be known as the "New Jersey School Boards Association."  [All boards] A board of education [of the various school districts] in this State [shall be members] may choose to be a member of, or choose to terminate its membership with, the association.

     2. N.J.S.18A:6-46 is amended to read as follows:

     18A:6-46.  [Each of the district boards] A district board of education that chooses to be a member shall select annually one of its members as a delegate to the association.

     3. N.J.S.18A:6-50 is amended to read as follows:

     18A:6-50.  For the purpose of defraying the necessary expenses of the association, the various district boards that choose to be members shall pay the necessary expenses incurred by its delegates, and shall appropriate annually such sums for dues as may be assessed by the association at any delegates meeting.  The assessment of dues shall be made upon a graduated scale and shall be made only upon two-thirds vote of the delegates present at such delegates meeting, after notice of the taking of such vote shall have been given to each district board in writing at least 60 days before such delegates meeting.  However, the dues assessed any board of education shall not be increased for any year by more than 33 1/3% of the dues assessed that board during the preceding year.  Dues shall be payable by the board secretary or treasurer of school moneys of the school district, as appropriate, to the treasurer of the association.

     4.  This act shall take effect immediately.

 

 

STATEMENT

 

     This bill removes the requirement that all boards of education of the various school districts in the State be members of the New
Jersey School Boards Association (NJSBA).  Under the bill, boards of education may opt out of NJSBA membership at any time, are not required to pay dues to NJSBA, and are not required to select a member as a delegate to NJSBA.

     Currently, all boards of education are required to be dues-paying members of NJSBA and they are required to annually select one member of the board to serve as a delegate to NJSBA.  This bill will make NJSBA membership optional.
