SYNOPSIS
Reallocates FY 2023 State and federal appropriations totaling $355,738,000, and amends and supplements language affecting appropriations in FY 2023.

An Act amending and supplementing the Fiscal Year 2023 annual appropriations act, P.L.2022, c.49.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Notwithstanding the provisions of P.L.2022, c.49, the fiscal year 2023 appropriations act, to the contrary, the following amounts of appropriations made in section 1 of P.L.2022, c.49 are deappropriated:

STATE AID
[Notwithstanding the provisions of any law or regulation to the contrary, the amount hereinabove appropriated for Trenton Capital City Aid is subject to the following condition: The City of Trenton shall enter into an agreement with the Department of Community Affairs setting forth the terms and conditions for receipt of such aid, which shall include financial and operational oversight by the Director of the Division of Local Government Services in the Department of Community Affairs.]
3. In addition to the amounts appropriated under P.L.2022, c.49, the annual appropriations act for the fiscal year ending June 30, 2023, there are appropriated from the General Fund and the Property Tax Relief Fund the following amounts for the purposes specified:

The amounts hereinabove appropriated for the Local Capital Projects Fund are appropriated to the Division of Local Government Services for a Local Capital Projects Grant Program to award grant funding to local governments for capital projects. The Director of the Division of Local Government Services shall establish an open and competitive application process for local governments to seek funding through the Local Capital Projects Fund and shall, to the extent possible, allocate funds equally among the northern, central, and southern regions of the State. Funding distributed to local governments through the Local Capital Projects Grant Program shall be distributed based on reasonable criteria that prioritize projects designed to protect life and property, prevent flooding, and provide publicly available recreational opportunities.
4. The following language provision in section 1 of P.L.2022, c.49, the fiscal year 2023 appropriations act, is amended to read as follows:

5. The following language is added to section 1 of P.L.2022, c.49, the fiscal year 2023 appropriations act:
FEDERAL FUNDS
The amount allocated from the federal “Coronavirus State Fiscal Recovery Fund” (SFRF) established pursuant to the federal “American Rescue Plan Act of 2021,” Pub. L. 117-2, for the Local Capital Projects Fund (ARPA) shall be deposited into the Local Capital Projects Fund. The Director of the Division of Local Government Services in the Department of Community Affairs shall ensure that the monies allocated for the Local Capital Projects Fund (ARPA) fund local capital projects, under the Local Capital Projects Grant Program, which are allowed under the federal “American Rescue Plan Act of 2021,” Pub. L. 117-2.
6. This act shall take effect immediately.
STATEMENT
The bill makes various changes to the Fiscal Year 2023 Appropriations Act.
The bill deappropriates a total of $355,738,000 in State and federal funds ($298,538,000 in State funds and $57,200,000 in federal American Rescue Plan Act (ARPA) funds) and reappropriates the monies for the Local Capital Projects Fund. New language provisions would require the Division of Local Government Services (“division”) in the Department of Community Affairs to administer the fund to award grants to local governments for capital projects through the Local Capital Projects Grant Program. The division would be required to distribute funding to local governments based on reasonable criteria that prioritize projects designed to protect life and property, prevent flooding, and provide publicly available recreational opportunities, and to the extent possible, allocate funds equally among the northern, central, and southern regions of the State. New language also specifies that the division is to ensure that ARPA funds appropriated to the Local Capital Projects Fund are used for project or purposes allowed under ARPA.
The sponsor of the bill seeks remove specifically named municipal capital projects from the Fiscal Year 2023 Appropriations Act in favor of fairly supporting all local governments in the State with regional balance through a competitive grant program.
