SYNOPSIS
Allows use of fuel not blended with ethanol for aviation purposes.

An Act concerning aviation fuel, and supplementing Title 26 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Notwithstanding the provisions of the “Air Pollution Control Act,” P.L.1954, c.212 (C.26:2C-1 et seq.) or any other law, or any rule or regulation adopted pursuant thereto, to the contrary, fuel to be sold or distributed for sale in the State for aviation purposes shall not be required to be blended with ethanol.
2. The Department of Environmental Protection shall adopt, pursuant to the “Administrative Procedure Act,” P.L.1968, c.410 (C.52:14B-1 et seq.), rules and regulations necessary for the implementation of this act.
3. This act shall take effect immediately.
STATEMENT
This bill would provide that any fuel to be sold or distributed for sale in the State for aviation purposes shall not be required to be blended with ethanol.
In the Energy Policy Act of 2005, Congress removed the oxygen content requirement for reformulated gasoline (RFG). On February 22, 2006, the United States Environmental Protection Agency published a direct final rule to amend regulations to remove the oxygen content standard and associated compliance requirements from the RFG regulations.
