SYNOPSIS
Permits school district to request and receive from MVC name and address of student’s parent or guardian to verify student’s eligibility for enrollment in school district.

An Act concerning eligibility for enrollment in a school district and supplementing chapter 38 of Title 18A of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. 1[A] In the case of a dispute between1 a school district 1and the parents or guardians of a student in regard to a student’s eligibility to enroll in the district or to remain enrolled in the district pursuant to the provisions of N.J.S.18A:38-1, the school district1 may request from the 1New Jersey1 Motor Vehicle Commission 2[a motor vehicle record including personal information,] the parent or guardian’s name and address2 for use in verifying a student’s eligibility for enrollment in the school district.
b. The 1New Jersey1 Motor Vehicle Commission shall disclose to a school district the information requested pursuant to subsection a. of this section in accordance with 2[the provisions of section 2 of P.L.1997, c.188 (C.39:2-3.4)] procedures established by the commission2.
c. 1A school district shall not condition enrollment in the district on immigration status.
2[d.1 As used in this section:,
“Motor vehicle record” means motor vehicle record as defined in section 1 of P.L.1997, c.188 (C.39:2-3.3).
“Personal information” means personal information as defined in section 1 of P.L.1997, c.188 (C.39:2-3.3).]2
2. This act shall take effect immediately.
