STATEMENT TO
ASSEMBLY, No. 485
with Assembly Floor Amendments
(Proposed by Assemblyman WEBBER)
ADOPTED: NOVEMBER 16, 2020
These Assembly floor amendments clarify that this bill applies to home businesses across the State. The amendments also clarify that a home business would be permitted as an accessory use not requiring a use variance by a municipality.
The amendments would delete the requirement that a home business cannot employ employees other than family members residing in the dwelling or unit. The amendments would also delete the provision allowing a municipality to establish limitations for home business including, but not limited to, those involving manufacturing, warehousing, retailing, or providing services, that a municipality would deem to be incompatible with the residential zones in which home businesses are located.
Lastly, the amendments also makes technical corrections in sections 2 and 3 of the bill and to the bill’s synopsis.
