ASSEMBLY, No. 2360
with Senate Floor Amendments
(Proposed by Senator GREENSTEIN)
ADOPTED: DECEMBER 20, 2021
These floor amendments would:
1) add a definition of "point of utility deliver" to the bill;
2) provide that the bill's provisions would apply only to residential unit owners, as defined by the bill, rather than to all residential customers in planned real estate developments;
3) provide that, for planned real estate developments that purchase electric commodity service from a third-party supplier, utilities would be required to offer comparable distribution charges to those offered to residential customers who receive basic generation service, rather than any agreed upon rate;
4) require utilities to cover the costs of certain electrical infrastructure modifications necessary for the installation of an electric vehicle charging station that provides Level 2 charging capability, under rates, terms and conditions established by the Board of Public Utilities (BPU), upon request from an applicant for electric service at a planned real estate development. Utilities would be entitled to a full and timely recovery of all such costs, and the BPU would be authorized to establish a maximum cost to be paid by utilities;
5) provide the bill would remain inoperative for 120 days after enactment, rather than 60 days; and
6) make technical and clarifying changes to the bill's language.
