ASSEMBLY, No. 4833
with Assembly Floor Amendments
(Proposed by Assemblyman SCHAER)
ADOPTED: MARCH 1, 2021
Assembly Bill No. 4833 expands the State’s bias intimidation law and removes an unconstitutional provision; establishes additional penalties for the crimes of bias intimidation and harassment; and provides for the award of bias intimidation motivation damages.
As introduced, the provisions of bill also expanded the crime of cyber-harassment to include knowingly disclosing the personal identifying information of another person with the intent to expose that person or another to harassment or risk of harm to life or property, or with reckless disregard of the probability of exposure of that person or another to harassment or risk of harm to life or property. These Assembly amendments remove these provisions from the bill.
