ASSEMBLY COMMITTEE SUBSTITUTE FOR

ASSEMBLY, No. 6088

      The Assembly Appropriations Committee reports favorably the Assembly Committee Substitute for Assembly Bill No. 6088.

      This bill authorizes municipalities to adopt an ordinance declaring that an all-terrain vehicle (ATV) or dirt bike unlawfully operated on any public street, highway, or right-of-way is an immediate threat to the public health, safety, and welfare and to designate the ATVs or dirt bikes as contraband subject to forfeiture pursuant to law.  The bill provides that an ATV or dirt bike forfeited under the bill is to be disposed of in accordance with State law on disposal of forfeited property or, at the discretion of the entity funding the prosecuting agency, destroyed.
