SENATE, No. 2593

with Senate Floor Amendments

ADOPTED: NOVEMBER 16, 2020

      These floor amendments eliminate references in the bill to deleted provisions related to retroactive modification of mandatory terms of imprisonment for second degree robbery, N.J.S.2C:15-1, and second degree burglary, N.J.S.2C:18-2.  This provision would have changed the terms from 85 percent of the sentence imposed, as required under current law pursuant to section 2 of P.L.1997, c.117 (C.2C:43-7.2), known as the No Early Release Act (NERA), to 50 percent of the sentence imposed.

      The floor amendments clarify that retroactive modification shall not apply to a conviction for leader of a narcotics trafficking network.

      These amendments make this bill identical to Assembly No. 4370(4R).
