      The Senate Budget and Appropriations Committee reports favorably Senate Bill No. 4207 (1R), with committee amendments.

      This bill increases the registration fees assessed under “The Public Works Contractor Registration Act,” P.L.1999, c.238, strengthens provisions of that law regarding the enforcement of the apprenticeship program requirements, and requires certification of compliance with federal requirements for apprenticeship programs.  The bill provides that if the State Commissioner of Labor and Workforce Development determines that a contractor is participating in an apprenticeship program which is not in compliance with those federal requirements, the contractor’s registration to preform public work way be revoked, but that determination will not affect the status of the registered apprenticeship program to continue operation in the State.  The bill also increases the penalties for misrepresentations in applications for contractor registration, including misrepresentation concerning apprenticeship programs.

 

COMMITTEE AMENDMENTS:

      The committee amended the bill to:

      (1) provide that for a false, deceptive, or fraudulent statement on a public works contractor registration form to be a violation under the bill, it must be “done”willfully”; and

      (2) exempt certain public works contracts, which are covered by the prevailing wage law thresholds but are lower than the higher public bidding thresholds, from certain registration requirements for public bidding.
